Welcome to Battery Near Me. By accessing our website (batteriesnearme.co.za), contacting us via 074 347 9479, or utilizing our mobile battery services, you agree to be bound by the following terms and conditions. These terms govern the relationship between Battery Near Me (“the Company”) and the customer (“you”), whether you are a domestic motorist or a commercial fleet operator.
1. Scope of Services
Battery Near Me provides a mobile automotive service within the Cape Town Metropole, including but not limited to:
- On-site battery testing and diagnostics.
- Supply and fitment of new automotive, truck, and deep-cycle batteries.
- Emergency jump-starts and battery breakdown assistance.
- Battery charging and basic auto-electrical system checks (alternator and starter motor).
2. Pricing and Payment
- Quotes: All quotes provided via phone or WhatsApp are based on the information provided by the customer. We reserve the right to adjust pricing if the vehicle’s actual requirements differ upon on-site inspection.
- Call-Out Fees: A non-refundable call-out fee is applicable to all mobile visits. This fee covers dispatch and diagnostic time. If a new battery is purchased and fitted during the same visit, the call-out fee may be waived at the Company’s discretion.
- Payment Terms: Payment is due strictly upon completion of the service on-site. We accept major credit/debit cards and electronic fund transfers (EFT). For approved commercial fleet accounts, payment terms are 30 days from the date of invoice.
- Scrap Credit: We offer a discount (“Scrap Credit”) on new battery purchases provided the customer returns the old lead-acid battery core to our technician for eco-friendly recycling.
3. Mobile Fitment and Delivery
- Service Area: Our mobile units operate exclusively within Cape Town and surrounding suburbs.
- Access: The customer must ensure the vehicle is in a safe, accessible location for our technicians and mobile units (such as our VW Caddy or light delivery bakkie).
- Arrival Times: While we aim for a 30–60 minute response time, arrival estimates are not guaranteed and may be affected by traffic, weather, or prior service commitments.
4. Comprehensive Warranty Terms
We supply premium-grade batteries engineered for the South African climate. The following warranty conditions apply:
- Warranty Period: Passenger vehicles typically carry a 12 to 24-month warranty, while commercial/truck batteries carry a 12-month warranty, unless otherwise stated on your invoice.
- Correct Application: The warranty is only valid if the battery is fitted to the correctly specified vehicle for which it was designed. Use in an incorrect application (e.g., a car battery used in a solar inverter system) voids the warranty.
- Claims Process:
- To initiate a claim, the original proof of purchase (invoice) must be presented.
- The battery must be returned to the Company for testing. If the battery is found to be discharged but not defective, a recharging fee and call-out fee will apply.
- Warranty claims only cover manufacturing defects.
- Warranty Exclusions: The warranty does not cover:
- Physical damage, including cracked casings, damaged terminals, or signs of tampering.
- Sulfation caused by the battery being left in a discharged state (common in vehicles left idle or during frequent load shedding).
- Overcharging or undercharging caused by a faulty alternator or voltage regulator.
- Explosions or internal damage caused by incorrect jump-starting procedures not performed by our technicians.
- Deep-cycle discharge in standard starting batteries.
5. Fleet and Commercial Heavy-Duty Terms
- 24V Systems: For heavy-duty trucks using dual-battery systems, both batteries must be replaced simultaneously to ensure voltage balancing. Failure to do so may result in premature failure and voided warranty.
- Maintenance: Fleet managers are responsible for ensuring that battery terminals are kept clean and that vehicles are driven regularly to maintain charge.
- Fleet Accounts: Corporate clients must provide a valid purchase order (PO) before a technician is dispatched to a logistics depot or roadside location.
6. Limitation of Liability
- Battery Near Me shall not be liable for any indirect, incidental, or consequential damages (including loss of profit or logistics downtime) arising from a battery failure or a delay in our mobile response.
- While our technicians perform auto-electrical checks, we are not responsible for pre-existing faults in the vehicle’s wiring, ECU, or mechanical components.
- Our total liability is limited to the replacement value of the battery or the cost of the service provided.
7. Protection of Personal Information (POPIA)
We process your personal information strictly to fulfill your service request and maintain your warranty records. For more information, please refer to our Privacy Policy. By requesting a service, you consent to our technicians receiving your location and contact details for the duration of the service.
8. Jurisdiction
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in Cape Town.
Customer Acknowledgment: By engaging our services, you acknowledge that you have read, understood, and agreed to these terms, specifically the conditions required to maintain your battery warranty.
